These Terms & Conditions (the “Terms”) govern your access to and use of Sufól Online Shop and the purchase of products from Sufol Creations Sdn. Bhd. (“Sufól”, “we”, “our”, “us”). By accessing the website, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy.

Important: Nothing in these Terms limits your rights under applicable Malaysian consumer laws, including the Consumer Protection Act 1999. To the fullest extent permitted by law, these Terms apply to all purchases made on shop.sufol.my.

 

1. Definitions

  • Website: shop.sufol.my and all related pages.
  • Customer/You: a natural person or entity purchasing products from the Website.
  • Products: furniture and related goods offered for sale on the Website.
  • Order: a purchase request submitted by you via the Website checkout process.
  • Working Days: Monday to Friday, excluding Malaysian public holidays.

 

2. Eligibility & Account

  • You must be at least 18 years old or have parental/guardian consent to use the Website and place Orders.
  • When you create an account, you agree to provide accurate, current, and complete information and to keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
  • We may suspend or terminate accounts that violate these Terms or where suspicious activity is detected.

 

3. Products, Specifications & Colors

  • Fixed Specifications: All Products sold via Sufól Online Shop come in fixed sizes, materials, and colors as shown. Customization is not available on this Website.
  • We take care to display product information, dimensions, and images accurately. Minor variations may occur due to:
    • batch production tolerances and material characteristics;
    • device screen settings and lighting conditions.
  • Accessories, décor, and props shown in images are not included unless expressly stated.
  • Assembly: Most Products require simple self-assembly. Assembly instructions are provided in-box or digitally. Incorrect assembly may cause damage and void warranty.

 

4. Pricing, Taxes & Promotions

  • Prices are listed in Malaysian Ringgit (RM) and, unless stated otherwise, are inclusive of applicable taxes.
  • We may run promotions, coupons, vouchers, store credits, or bundle offers. Unless stated, promotions cannot be combined and are non-transferable.
  • Voucher codes must be entered at checkout and cannot be applied after an Order is placed.
  • We reserve the right to modify prices, fees, and promotions at any time. Confirmed Orders are not affected by subsequent changes.
  • In the event of a pricing or typographical error, we may cancel any affected Order and refund the amount paid.

 

5. Orders, Acceptance & Verification

  • Your Order is an offer to buy. Order acceptance occurs only when we issue a formal Order Confirmation email and/or dispatch notification.
  • We may reject, cancel, or limit quantities for any Order at our discretion, including due to availability, suspected fraud, or errors.
  • We may contact you to verify identity, delivery details, or payment information. Failure to provide verification may result in cancellation and refund.

 

6. Payment & Security

  • Payment methods are as displayed at checkout and are processed by licensed third‑party payment gateways. We do not store your full card details.
  • All payments must be authorized at the time of purchase. Orders unpaid after checkout may be automatically cancelled.
  • If a chargeback or payment dispute is initiated, we may suspend fulfillment, request supporting documents, and/or pursue recovery of amounts due.

 

7. Shipping, Delivery & Risk of Loss

  • Coverage: Delivery is available within Malaysia. Delivery to Sabah & Sarawak may be limited or unavailable unless expressly stated at checkout.
  • Fees & Timing: Delivery fees and estimated timelines are shown at checkout. Timelines are indicative and may vary due to courier schedules, public holidays, weather, or other factors beyond our control.
  • Address Accuracy: You are responsible for providing a complete and accurate delivery address and for ensuring access for delivery. Re‑delivery or address changes may incur additional fees.
  • Risk Transfer: Title and risk in the Products pass to you upon delivery to the shipping address (or collection by you/your agent). Please inspect packages upon receipt.
  • Delivery Attempts: If no one is available to receive the package, the courier may attempt re‑delivery or hold at a collection point. Storage and re‑delivery charges may apply.
  • Partial Shipments: We may deliver items in multiple shipments at no extra charge where necessary.

 

8. Inspection on Delivery, Missing or Damaged Items

  • Please inspect your order immediately upon delivery. For any visible damage, missing parts, or incorrect items, notify us within 48 hours with clear photos/videos and your Order Number.
  • Keep all original packaging until your claim is resolved. We may require return of the damaged item and/or packaging for investigation.
  • For missing parts/hardware, we will send replacement parts within a reasonable period. Where parts are unavailable, we may offer a replacement unit or refund.

 

9. Returns, Exchanges & Refunds

    • Change‑of‑mind returns are not accepted.
    • We accept returns or exchanges only if:
      1. the item was damaged on arrival; or
      2. you received the wrong item.
    • Process:
      • Submit a claim within 48 hours of delivery via our customer service channels with photos/videos and a description of the issue.
      • Our team may troubleshoot and propose a remedy (e.g., replacement parts, exchange, or refund).
      • If a return is approved, you must return the item in original condition and packaging. We will arrange collection or provide a return label.
    • Refund Method: Approved refunds are processed to the original payment method. Processing times depend on your bank/payment provider.
    • Non‑returnable items: Items that have been assembled, used, altered, or not in original packaging; clearance/final sale items (where stated); and items damaged due to misuse or improper assembly.

10. Warranty

  • Products are covered by a limited warranty against manufacturing defects for [insert period, e.g., 12 months] from the delivery date, unless otherwise stated on the product page.
  • The warranty does not cover: normal wear and tear; natural variations in materials; damage from misuse, improper assembly, modifications, exposure to moisture/heat/sunlight beyond intended use, or commercial use unless specified.
  • Remedies under warranty are limited, at our option, to repair, replacement of the affected component/product, or refund of the purchase price.
  • To make a warranty claim, contact us with your Order Number, photos/videos, and a description of the issue. We may require inspection or return of the item.

 

11. Product Care & Safety

  • Follow assembly instructions and use appropriate tools. Seek assistance for heavy lifting.
  • Do not stand on furniture or exceed stated weight limits. Anchor tip‑prone furniture to walls where instructed.
  • Use on level, dry surfaces and keep away from open flames or prolonged direct sunlight unless the product is designed for such exposure.

 

12. Gift Cards, Store Credit & Promotional Codes

  • Gift cards and store credits (if available) are non‑refundable, cannot be exchanged for cash, and may be subject to expiry dates.
  • Lost or stolen gift cards will not be replaced.
  • Promotional codes are valid only for the period and on the terms stated and cannot be applied retroactively or transferred.

 

13. User Content (Reviews & Feedback)

  • By submitting reviews, photos, or feedback, you grant Sufól a non‑exclusive, royalty‑free, perpetual, worldwide license to use, reproduce, modify, and publish such content for marketing and service improvement.
  • You represent that your content is accurate, non‑infringing, and lawful. We may remove content that is abusive, misleading, or violates rights/laws.

 

14. Third‑Party Services & Links

  • We may use third‑party providers for payment processing, hosting, analytics, logistics, and customer communications. Your use of their services may be subject to additional terms and privacy policies.
  • We are not responsible for third‑party websites or services linked from the Website.

 

15. Data Protection

  • We handle personal data in accordance with the Personal Data Protection Act 2010 (PDPA Malaysia). Please refer to our Privacy Policy for details on collection, use, disclosure, and your rights.

 

16. Limitation of Liability

  • To the maximum extent permitted by law, Sufól shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use, arising out of or related to your use of the Website or Products.
  • Our total liability for any claim relating to a Product shall not exceed the purchase price of that Product.
  • Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Malaysian law.

 

17. Indemnity

  • You agree to indemnify, defend, and hold harmless Sufól and its directors, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising from your breach of these Terms, misuse of the Website, or violation of any law or third‑party rights.

 

18. Force Majeure

  • We are not liable for delays or failures in performance due to events beyond our reasonable control, including acts of God, natural disasters, epidemics, wars, strikes, governmental actions, supply chain disruptions, or failures of third‑party networks or utilities.

 

19. Errors, Availability & Changes

  • We reserve the right to correct any errors or omissions on the Website, update or discontinue Products, and revise these Terms at any time. The latest version will be posted on the Website and becomes effective upon posting.

 

20. Prohibited Uses
